The process of obtaining a divorce is comparatively straightforward; it is the ancillary issues, such as resolving a couple's finances which can be more complicated.

In order to obtain a divorce you will need to show that your marriage has irretrievably broken down for of one of five reasons, these are:

  • adultery
  • behaviour (more commonly known as unreasonable behaviour)
  • desertion
  • two-years separation with the agreement of both parties.
  • Five years separation

A divorce petition will need to be drafted setting out the details of breakdown, and including any financial claims that the person applying for divorce, (the Petitioner), wishes to make against their spouse (the Respondent). We will take care to discuss and explain each stage with you in detail.

The divorce process can take between 4-6 months, however obtaining the final divorce order, the Decree Absolute, does not usually take place until the parties' finances have been resolved.
